  • Cloud services such as AWS and GCP
  • Third-party AI model services

When you use third-party services, you must also comply with their respective terms and policies.

4. AI and Voice Service Statement

Qubby AI provides AI voice support, AI IVR, AI outbound, AI agents, and omnichannel support features. You understand and agree that:

  • AI responses may contain errors, omissions, or delays
  • AI content does not constitute legal, medical, financial, or professional advice
  • AI voice services may operate via third-party AI models
  • We do not guarantee the accuracy or suitability of AI responses

5. User Conduct

When using the service, you agree to:

  • Comply with all applicable laws and regulations
  • Respect the rights of other users
  • Not engage in any disruptive or malicious behavior
  • Not use the service for illegal activities
  • Not attempt unauthorized access to systems or data

6. Prohibited Uses of AI Outbound and Voice Services

When using Qubby AI voice services, you must not:

  • Use AI outbound for fraud or deception
  • Spoof Caller ID information
  • Use AI to impersonate a real person
  • Use AI to mimic a specific individual's voice in a misleading way
  • Make harassing or threatening calls
  • Circumvent opt-out or do-not-call mechanisms
  • Repeatedly call numbers on a do-not-call list
  • Conduct telemarketing without consent

7. Customer Legality Warranty

By using Qubby AI services, you represent and warrant that:

  • You have lawfully sourced contact data
  • You have obtained the necessary consent as required by law
  • Your intended use complies with applicable regulations
  • You will provide recording notices as required by law
  • You are responsible for the legality and completeness of the data you provide

8. Platform Review and Suspension

To maintain service quality and regulatory compliance, Qubby AI reserves the right to:

  • Monitor abnormal traffic and usage behavior
  • Review call patterns and system usage
  • Suspend or terminate violating accounts
  • Restrict abnormal API access
  • Cooperate with authorities in lawful investigations

In the event of serious violations, we may suspend service immediately without notice.

9. Built-in Compliance Controls

The Qubby AI platform may provide the following compliance-control features:

  • Blocklist management
  • Call-frequency limits
  • AI identity disclosure
  • Call-recording notice
  • Anomalous-behavior detection
  • Permission controls
  • API usage limits

Customers must comply with relevant regulations and platform rules when using the service.

10. Allocation of Responsibility

Regarding the allocation of responsibility for this service:

  • Customer responsibility: The customer is responsible for their data sources, knowledge-base content, call settings, and intended use
  • Platform responsibility: Qubby AI provides the technical platform, AI features, and system infrastructure
  • Third-party responsibility: Issues caused by third-party platforms, telecom services, or AI model providers are handled per their respective terms

11. Recording and AI Identity Disclosure

Calls made through Qubby AI may be recorded for:

  • Quality improvement
  • Dispute resolution
  • Service analysis
  • System optimization

AI voice assistants should appropriately disclose their AI identity and not deliberately pretend to be human.

12. Customer Data and Knowledge-Base Content

When customers use the knowledge base, document upload, or API integration features:

  • Customers must ensure data sources are lawful
  • Customers must not upload infringing or illegal content
  • Customers must verify data accuracy themselves
  • Customers must manage data permissions themselves

We are not responsible for the legality of content uploaded by customers.

13. Intellectual Property

All service content, including but not limited to:

  • Platform interface
  • System design
  • Source code
  • Trademarks
  • Images
  • AI workflows

is owned by Qubby AI or its rights holders and is protected by intellectual property law.

14. Data and Privacy

We handle your data in accordance with our Privacy Policy. By using the service, you consent to our collection, processing, and use of relevant data in accordance with the Privacy Policy.

15. Service Changes and Suspension

We may at any time:

  • Modify service content
  • Adjust features
  • Restrict certain features
  • Suspend part or all of the service

We may also suspend service due to system maintenance, third-party service issues, or regulatory requirements.
